§ 1. General Provisions- The online store available at the domain address climberplay.com is operated by Wiktor Szejko conducting business activity under the name PlayScope Climberplay, with its registered office Gen. Józefa Hallera 42 / 114, 15-814 Białystok, Poland, Tax Identification Number (NIP): 12345678 (hereinafter referred to as the "Seller").

- These Terms and Conditions define the rules for using the Store, placing orders for physical products (in particular, the PlayScope device), executing deliveries, the procedure for withdrawal from the contract, and the complaint handling procedure.
- The Store conducts retail sales to individual customers (Consumers) as well as wholesale and distribution sales to business entities (Distributors). The Seller reserves that the priority business model of the Store is long-term cooperation with distributors.
- The Store sells within the territory of the Republic of Poland and selected countries of the European Union (EU).
- All prices stated in the Store are gross prices (including VAT, if applicable) and do not include delivery costs.
§ 2. Technical Requirements and Guest Checkout- Creating or holding a user account is not required to use the Store or to place an order. The Store enables purchases exclusively via guest checkout.
- To place an order, it is necessary to have a terminal device with access to the Internet, an active e-mail address, and enabled cookie support in the web browser.
§ 3. Placing and Fulfilling Orders- The Customer makes a purchase by adding the Product to the cart, filling in the order form (delivery data and, optionally, invoice data/Tax ID), and selecting the delivery zone and payment method.
- The condition for finalizing the order is the acceptance of these Terms and Conditions by clicking the button confirming the order with an obligation to pay (e.g., "Order and Pay").
- After placing the order, the Customer receives an automatic e-mail message confirming receipt of the order by the Store, which constitutes the moment of conclusion of the distance sales contract.
§ 4. Payments- The entity providing online payment processing services in the Store is the Stripe system.
- The Customer may pay for the order using the payment methods made available at any given time by the operator Stripe (including credit/debit cards, fast electronic transfers, or mobile payments).
- The order is processed immediately after the Seller receives confirmation of successful payment authorization from the Stripe system.
§ 5. Delivery and Shipping Costs- Delivery of Products is carried out via courier companies: DPD, DHL, UPS, or GLS.
- The delivery cost depends on the destination country and is automatically calculated in the shopping cart based on allocation to one of three shipping zones (Zone 1, Zone 2, or Zone 3). The exact transport cost is presented to the Customer before final confirmation of the order.
- The approximate delivery time within the EU is indicated to the Customer during the checkout process.
§ 6. Right of Withdrawal (Free 14-Day Returns – Applies Exclusively to Consumers)- A Customer who is a Consumer (a natural person purchasing goods for private purposes, unrelated to their commercial or professional activity) has the right to withdraw from the sales contract without giving any reason within 14 days from the day on which they take possession of the Product.
- To exercise the right of withdrawal, the Customer must inform the Seller of their decision by e-mail at: info@climberplay.com (the model form is attached as Appendix No. 1).
- The Seller offers the Consumer free returns via a courier designated by the Seller. Upon receiving the notification, the Seller will provide the Customer with a prepaid shipping label via e-mail or arrange for their own courier to collect the package.
- The Seller does not accept return packages sent by the Customer cash on delivery (COD). The Seller also does not reimburse the costs of independent shipment of the Product by the Customer if the Customer did not use the prepaid label provided by the Seller.
- The refund for the purchased Product will be issued only after the Product has been delivered back to the Seller and its technical condition has been successfully verified. If the returned Product shows signs of use exceeding what is necessary to establish the nature, characteristics, and functioning of the goods, the Seller has the right to reduce the refund amount accordingly.
- The refund will be processed using the same payment method used by the Customer (via the Stripe system), within 14 days from the moment of verification of the Product.
§ 7. Cooperation with Distributors (B2B Provisions)- The provisions of this section apply exclusively to Customers who are not Consumers (Distributors, entrepreneurs, companies making a purchase for professional/commercial purposes).
- In relations with Distributors, the right to withdraw from the sales contract (return of goods within 14 days without giving a reason) is completely excluded. Every purchase is binding and final.
- The Seller's liability under statutory warranty for physical defects (rękojmia) towards Distributors is excluded (pursuant to Article 558 § 1 of the Polish Civil Code).
- The Seller invites entities interested in the permanent distribution of PlayScope devices to contact them directly at info@climberplay.com in order to establish individual commercial terms, volume discounts, and dedicated distribution agreements.
§ 8. Complaints (Conformity of Goods with the Contract for Consumers)- The Seller is obliged to deliver a Product that conforms to the contract and is free from defects.
- In the event of non-conformity of the Product with the contract, the Consumer has the right to file a complaint by e-mail to: info@climberplay.com.
- The Seller will respond to the complaint within 14 days from the date of its receipt.
§ 9. Intellectual Property and Patent Protection- The PlayScope device offered in the Store is an original design and invention of the Seller, which is subject to full legal protection and holds a patent granted by the Patent Office.
- All materials posted in the Store, including texts, photos, graphic elements, layout, trademarks, logos, and technical-construction documentation of the PlayScope product, are the intellectual property of the Seller and are protected by copyright law and industrial property law.
- Unauthorized copying, reproduction, imitation of the technical and structural solutions of the PlayScope device, as well as dissemination of materials related to it without the express, written consent of the Seller is strictly prohibited and will result in legal action and claims for damages.
§ 10. Final Provisions- In matters not regulated by these Terms and Conditions, the generally applicable provisions of Polish and European Union law shall apply.
- Pursuant to EU Regulation No. 524/2013, the Seller informs about the existence of the European Online Dispute Resolution (ODR) platform, available at: http://ec.europa.eu/consumers/odr.
